Fractional Co-Ownership Resource Page
This site contains the most comprehensive body of information on real estate fractional co-ownership and homeowner associations available on the internet. It provides both basic information suitable for homeowners or home buyers with no real estate background, and more sophisticated information for real estate professionals and attorneys. There are separate articles on various co-ownership topics, each one organized in a simple ?Q & A? format and written in plain English. There are also links to relevant laws, newspaper articles, books (including one you can download), and other resources.
About Our Background and Practice
Our law practice is devoted exclusively to fractional vacation homes, tenancy in common (TIC), equity sharing, shared appreciation mortgages, investment partnerships, unmarried couples, and other co-ownership matters. Since 1985, we have prepared co-ownership agreements for over 6,000 clients and have converted over 2,500 condominiums. Although we are based in San Francisco, we regularly work on projects located throughout California, and have also worked on projects in nine other U.S. states, and in Italy, France, Argentina, Nicaragua, Costa Rica, Panama, Dominican Republic, Nicaragua, Belize and Mexico. Our staff includes attorneys Andy Sirkin, Lyssa Paul, Sarah Clark Hopkins, and Rosemary MacGuiness, and paralegals/administrative assistants Laurajane Johnson and Cam Perridge.
Although we do not advise or represent clients regarding landlord/tenant matters, we are generally familiar with the law in this area and have included information about eviction-related issues often of interest to our clients such as owner-move in laws and the Ellis Act. We refer eviction-related matters to attorneys specializing in landlord/tenant matters.
We do not advise or represent clients in disputes, but do provide mediation services. If needed, we are happy to provide referrals to real estate litigation attorneys with experience in co-ownership disputes.
In addition to advising clients, Andy has personally developed more than 30 residential and mixed-use projects in the Bay Area, and managed the real estate brokerage Property Resource Group for six years. He is an accredited instructor with the California Department of Real Estate, and frequently conduct co-ownership workshops for attorneys, real estate agents, corporations, and prospective home buyers. He is a vocal advocate for creation of affordable home ownership opportunities, and has made numerous appearances on San Francisco Bay Area television and radio, and addressed the Commonwealth Club of California.
Andy is the co-author of The Condominium Bluebook, published annually by Piedmont Press, and The Equity Sharing Manual, first published by John Wiley and Sons in November 1994 (download the current edition in PDF).
